Such websites are fading into the past, not just for omo, but adult content in general. Mainly in reaction to revenge porn sites, lawmakers around the world, but also in the US, have passed several new laws while expanding others. Among the requirements of these new laws, in the US at least, is one of keeping and verifying proof of age records for performers. While this had been a requirement for the primary producers of adult content since 1996, the law has now been expanded to require that "secondary" producers also keep copies of these records. Secondary producers include websites that distribute or make available any content that is subject to these record keeping requirements. Other laws set up specific affirmative permission requirements, where a content distributor could be sued by the subject of the video if that person didn't first give affirmative written permission for its use. This law is extremely narrow in scope, and only applies to adult content that is only being used for entertainment purposes, but it exists. A handful of other laws also place legal liability on websites and their owners if they host any non-consensual content, or content that is involved with any kind of human trafficking. Previously, websites were protected from legal liabilities if their users uploaded illegal content, as long as they acted in good faith to remove such content and prevent users from uploading that content again when it was reported. But, now, that isn't enough. Websites must now proactively verify ages, keep proof of age records, and seek affirmative permission of the subject in the video. Now, there are still plenty of sites, obviously, that are trying to get around these laws. Site's like xvid and PornHub require uploaders to check boxes that they agree to all kinds of stipulations when they upload content, as a way of trying to sort of comply with these laws and switch the compliance burden to their uploaders. However, such tactics really don't get around the law, which is why we are seeing the owners and operators of these sites take steps to shield themselves and relocate their businesses to areas outside of US legal jurisdiction. Other sites, I think, hope that they are too small to be noticed by officials, or have an incorrect understanding of what their legal requirements are. For example, USC 18.2257 is the age verification and record keeping requirement law in the US. To be compliant, adult content sites must contain a 2257 statement that is linked to from every page containing visual adult content. The compliance statement has to affirm that all models were 18 and older at the time of production, state where the proof of age records are located and the custodian of these records, and when those records are available for inspection by law enforcement. But, many sites have kind of psuedo 2257 disclaimers that don't contain all this information. An incomplete 2257 statement is legally the same as having none at all, and as far as legal penalties go, this is a felony at the same level as if you were producing child porn. Now, you might say, "OK, but this only has to do with US sites." And while this is true, it is really hard for websites to operate completely outside of US jurisdiction. Top level .net and .com domains are under US jurisdiction, as well as many cloud computing and hosting companies that offer various services. There are the analytics tools that websites use, hosted code and font libraries, payment processing companies and banks, and DNS servers. At some point, most websites have some element that is exposed to US regulation. As you can probably tell, all this means that it is very difficult to have websites that allow users to upload adult content. The websites that still do this aren't doing so in a way that is entirely legal, and just like other legally questionable past websites (Warez anyone?) eventually such sites will fade from existence.
