Is it dangerous to have loli saved on one's personal computer?

Recommended Posts

Hey everyone; sorry if this is in the wrong forum (I wasn't sure if it would fall under general or off-topic).  I'll reiterate the question; would it be dangerous or illegal to have loli (small amounts) saved on one's computer?

It's a few of the ecchi, doujin manga that I've found and they all mainly show wettings. Any help or clarity would be great, thanks.

These are questions for a lawyer, and the answer can vary greatly depending on your specific legal jurisdiction.

In the U.S. any portrayal of a person, including text, drawings, computer renderings, photographs, videos, etc. of a person who is under 18 and the depiction is qualified as a "lascivious sexual display" and if the depiction lacks any "serious artistic, educational, or scientific merit" than it is considered to be illegal.

But the answer here isn't just black and white- There is a lot of gray area.  It isn't illegal until a court says it is illegal, but once that happens it is too late, you are in serious trouble.

First question you need to ask is- Are you likely to be investigated? Authorities need to have some probable cause to search your devices, then they need to go get a warrant.  This actually happened to me- The threshold for probable cause is extremely low, in my case it was an ex-girlfriend who was mad at me because she thought I owed her money, so she filed a complaint and that was enough to give them probable cause.

Now, if you are investigated, you are going to need a lawyer.  The police aren't trying to determine if you are guilty or innocent, but gather the best evidence of your guilt to hand to a prosecutor to decide to charge you or not.  This process can take years, and anything on your computer that is even a little suspicious is going to be used against you.  They are also going to look at all of your online activities, subpoenaing all of the companies that provide you any kind of internet or communication service.

Even if they don't find anything that is specifically illegal, if they are convinced you have been involved with illegal online activities, the prosecutor may still choose to file charges, despite the lack of evidence, in order to try to force a plea deal.  Most people can't afford to mount a defence to criminal charges, so the only option is to plead guilty, no matter what evidence is actually there.

If it does go to trial, how do you think a jury of randomly selected people would interpret what you have on you computer?  Especially combined with cherry picked parts from all your past posts, e-mails, online communications, and placed in the context of everything else you look at online?

I’ve never heard of anyone getting in trouble for it in the US, our free speech laws give a lot of grey area and wiggle room for what can be considered art.

Other countries are more strict, I remember someone getting arrested at the Canadian border for having Simpsons porn years ago.

There are no shortage of U.S. cases where people have been prosecuted for such material.  It took me less than 30 seconds to find this one- https://www.metafilter.com/76862/Man-arrested-for-possession-of-explicit-manga
